1. About These Terms

ShopCommand (“we”, “us”, “our”) provides a software-as-a-service platform for Australian automotive workshops. By accessing or using the ShopCommand platform at shopcommand.com.au, you (“Customer”, “you”, “your”) agree to these Terms of Service.

If you do not agree with these terms, please do not use the platform.

2. Eligibility

You must be:

  • A representative of an Australian-based automotive workshop or related business
  • At least 18 years of age and authorised to enter into binding agreements on behalf of your business
  • Compliant with all applicable Australian laws

3. Subscription and Billing

ShopCommand operates on a monthly subscription basis. Pricing tiers and inclusions are listed on shopcommand.com.au/pricing.

3.1 The Workshop Essentials tier may include a promotional first-month price (currently $1 AUD) followed by recurring monthly billing.

3.2 The SAM (AI Receptionist) tier includes a one-time non-refundable setup fee of $99 AUD at signup, followed by recurring monthly billing.

3.3 Subscriptions auto-renew monthly until cancelled.

3.4 You may cancel your subscription at any time through your account settings. No long-term contracts apply.

3.5 We reserve the right to update pricing with 30 days written notice via email.

4. Acceptable Use

You agree not to:

  • Use the platform for any illegal or unauthorised purpose
  • Attempt to reverse engineer, decompile, or extract source code
  • Resell, sublicense, or transfer access to third parties without our written consent
  • Use the platform to send unsolicited communications (spam)
  • Interfere with the security or performance of the platform
  • Misrepresent your identity or impersonate others

5. Customer Data

You retain ownership of all data you submit to the platform (“Customer Data”). By using the platform, you grant us a limited licence to process this data for the purpose of providing the service.

Our Privacy Policy describes how we collect, store, and use personal information.

6. AI Services (SAM and Job Card Writer)

The SAM AI Receptionist and Job Card Writer modules use third-party AI providers (currently Retell AI and Anthropic). By using these features, you acknowledge:

  • Call recordings, transcripts, and job card inputs may be processed by these third parties
  • AI-generated content (call responses, job card text) is provided as-is
  • We do not guarantee the accuracy of AI-generated content; you remain responsible for verifying critical information

7. Service Availability

We aim for high availability but cannot guarantee uninterrupted service. We are not liable for downtime caused by:

  • Scheduled maintenance (advance notice provided where possible)
  • Third-party provider outages (Telnyx, Retell AI, Anthropic, Stripe, Resend, Supabase, Vercel)
  • Force majeure events

8. Limitation of Liability

To the maximum extent permitted by Australian law, our total liability for any claim arising from your use of the platform is limited to the fees paid by you in the three months preceding the claim.

We are not liable for indirect, consequential, or incidental damages including lost profits, lost data, or business interruption.

Nothing in these Terms excludes any non-excludable consumer rights under the Australian Consumer Law.

9. Termination

We may suspend or terminate your access if:

  • You breach these terms materially
  • You fail to pay outstanding fees after 14 days notice
  • We are legally required to do so

Upon termination, you may export your data for 30 days, after which we may delete it.

10. Changes to These Terms

We may update these terms from time to time. Material changes will be communicated by email at least 30 days in advance.

11. Governing Law

These terms are governed by the laws of Western Australia, Australia. Disputes will be resolved in the courts of Western Australia.
